MEMO from Gary Krasner, Coalition For Informed Choice October 3, 2021 If you're a teacher, or any worker opposing the covid vaccine mandate, you will want to read this word for word transcript of my email discussion with Michael Kane, head of NY Teachers For Choice. He represents teachers who are resisting the covid vaccines. In early Sept, Bud Weiss, who was a friend and a union supporter, pleaded with me to draft a defense of the employees under the gun of the mandate. They we being demonized in the media and blamed for the spread of covid. I felt that it was important to lift their pariah status and personalize this affair (in Saul Alinsky style) by taking away the moral high ground from Blasio, Biden, Cuomo and Fauci. Bud asked me to write some kind of employee disclaimer at the end of my document, so I did that too. That 12 page document is attached: "Employees Pushing Back on Mandates.pdf" I gave it to Bud, and to one of my teacher clients who is on the steering committee of NY Teachers For Choice, to give it to Michael Kane. When Bud made his request, he told me that he had a connection to the leadership of NY Teachers For Choice, and that my document would be distributed to the membership. I didn't know at the time who was leading the organization, but I accepted Bud's word on the matter. The document was completed at noon on Sept 13, which was 4 hours before the major protest rally by teachers and other workers. That's when I sent the pdf file to Bud and my client. After one week, i wondered why I didn't receive feedback from anyone. My name, phone and email was on the document. Bud and my client told me they sent the file to Kane. I obtained Kane's email address and sent the document, along with 3 other documents that would help employees rebut the reasons NYC was denying exempltions: (1) Catholics canno claim exemption (2) The public health concerns require that we limit exemption (3) there isn't blood in the covid vaccines. That last file was written by a brilliant scientist, Irina Dzyubinsky, who had also drafted a document in April 2019 proving there's blood in all the mandated vaccines for school. These documents had helped our clients obtain exemptions over the years, and we wanted to make them available to employees seeking religious exemption. But these aids in getting exempt, plus the document which would have reinforced solidarity among workers-----"Employees Pushing Back on Mandates.pdf"-----was never posted or emailed to any employees. The transcript shows that from Sept 13 to the current date (Oct 3), Kane didn't have the time to read it. And will not have the time until after the lawsuit. John Gilmore (john gilmore ) had also received "Employees Pushing Back on Mandates.pdf" on Sept 13, and didn't post it. But I expected that. 10 years ago I gave him my 5,000 email list to use, in exchange for an occassional posting about exemptions using his bulk email software. He reneged on that deal. Not even to post my 2019 information on how to go forward after the repeal! But why is Kane sitting on these files going on two weeks and more? He writes that he won't even have time to post them next week either!! Irina Dzyubinsky has degrees in pharmacology and toxicology. Does he want to proof read her document about blood in covid shots?! Does he have legal expertise in the other documents as well?! His organization is hemorrhaging members who are caving in to the mandates now. He lost 10,000 members in the two weeks he's been sitting on "Employees Pushing Back on Mandates.pdf". A document that can boost their morale should be distributed NOW. Winning the lawsuit will only force DoE to extend more due process to applicants. DoE will still find ways to deny exemptions. I dealt with them for 20 years. The only leverage that NY Teachers For Choice has is the numbers who resist vaccination. When that number goes low enough, those who resisted will be replaced. No one can win a public debate while being portrayed as pariahs without moral authority. Tell him he's making a mistake by waiting. Just by way of background, Coalition For Informed Choice started out as an activist/advocacy organization. In the late 1990s, I wrote about the nature of disease: http://vaclib.org/basic/gk2/index.htm (Today, CFIC is back involved with advocacy with "Employees Pushing Back on Mandates.pdf" (attached) and more publications to come.) By 2002, I wrote 3 bills (religious, medical, and philosophical) and had them introduced first in the NYS Senate, then the Assembly a year later. But by 2004, I focussed exclusively on helping parents obtain religious exemptions for school vaccinations in the hardest state in the nation-----NYS. Since that time, CFIC won exemptions for several hundred parents, using a formula that has never been successfully challenged. That formula wasn't always enough to win. Sometimes CFIC had to negotiate with schools, and "pushback" on their demands. Only about a dozen times we had to appeal to the commissioner. "Omnibus-updates-forms-approvals.pdf" (attached) is one of dozens of pushback letters and related strategies that CFIC used to use for school vaccine exemptions in its support services. "Blood in COVID mRNA Vaccines.pdf" and "Pushback Letter Supporting Catholic Exemptions - cfic.pdf" are examples of our current (i.e. Covid) pushback letters that we sometimes use to preempt challenges. - - - - - - - - - THE CURRENT COVID MANDATES - - - - - - - The COVID vaccine-----and its collateral safety mandates (face masks, virus testing, etc)-----is being required for public and non-public employers. And like other vaccines, my expertise in helping people write exemption statements is still available at the same low price of $150. Law firms start at about $1000 and up and do not provide tested religious rationales. They roll the dice and hope for the best. Our DIY ("do it yourself") kit is comprehensive, and contains sample statements for every religion except Islam (240 statements at 8 pages average size), and complete instruction sets for every step. The learning curve may take 5 to 10 days for you to complete. But I can't appeal adverse decisions like I used to with grade school vaccines. That's because the NYSED commissioner (under Section 310 appeals) has no jurisdiction for colleges or employees. A lawyer would have to bring the case to state supreme court or federal court. Additionally, unlike the school vaccine mandates, these requirements are mandates from executive branch agencies. No legislatures have authorized them. Moreover, they're still under judicial review as of Sept 28. So not only might they be struck down by the courts, these COVID mandates don't seem to have due process protections and guard rails against abuse of process. Employees are often given one day to appeal, or are not given a reason for denial, or they're provided with the public health equities for the denial (and not given reasons why the religious explanation was found to be deficient), or they're required to submit a support letter from their minister or priest or rabbi. All of those requirements----and those like them----would be against the rules governing the proceedings for grade school vaccinations. But there are no rules like that for college students, or for employees. Since I'm not a lawyer, I had to work within the rules and push back when the institution violated the rules. If the school wouldn't relent, then I had grounds to take it to an administrative appeal (i.e. Section 310 appeal) or find a lawyer to take the complaint to state supreme court. But the COVID mandates for colleges and workplace do not have any rules, except "get the vaccine" or "get lost." Going forward, religious exemptions may or may not be in place, and may or may not remain in place, and may or may not include due process protections, let alone any uniform rules at all! Some employees can't even identify who is in charge (name and title!) of making the determination that denied their application!! So there's no one to whom a complaint can be lodged!! BOTTOM LINE: You have two options. Get a lawyer or move out of NYS. Final Note: Some may deem the file, "Employees Pushing Back on Mandates.pdf" to be an anti-Democrat screed (the first 2 pages, at least). It is not. It's a "wake the hell up" screed. You paid union dues that funded Democrats in their elections. Once they achieved a trifecta in Albany for the first time since 1913, they voted to repeal religious exemptions for our children in 2019, and are now giving you an ultimatum-----get the COVID vaccine or get fired. This was NEVER a partisan issue. This SHOULD NEVER have been a partisan issue. It is only a partisan issue now because Democrats have revealed themselves to be irrationally pro-vaccine authoritarians. This is your wake-up call. Because an "appeal" is a rebuttal to the REASON for an adverse decision. Without knowing the reason, one cannot rebut it. This is well grounded in US jurisprudence. Withholding the reason why you were denied is a big deal violation. I know 67 non vaccinating lawyers who were my clients over the last 20 years. I've worked most closely with Aaron Siri, Charles Nicholas, and Robert Krakow. These guys litigate on this issue and might be helpful, because I don't know Gibson. Since 2017, I trained associates with the Nicholas firm to take over my work in admin law appeals. One thing I learned is that lawyers can be smart, but they can be beaten if they don't know the specialty well enough. And from 2005 to 2016, I beat school lawyers in over half of my cases with the highest burden of proof (equivalent to traffic court!). I just knew this area of law well. And I never told a loser, "you deserve your day in court" (i.e. a loser was someone with a deficient statement!) I wrote the attached documents. It's a sampling of the kinds of pushback documents that were useful with school vaccines. But they're useless for employees. This is what I meant in my first email: there are no rules or due process protections for workers claiming religious objections. Without rules to exploit, I can't push back of institutions who violate them. All I'm able to do now for them is prepare an unassailable religious statement. And we'll know shortly if even that will be possible. The few who got hold of it told me that they felt like it gave them back the moral high ground, which is vital in this struggle. You can't win without it. Besides the moral high ground, one must not accept the premises of your opponent. That 12 page document does both. Workers must feel proud and righteous. that's what it does. And it does a third thing. It isolates and targets (personalizes) our opponents in Saul Alinsky style. You cannot get people aroused by writing "public health officials claim . . . " I named Biden, Cuomo, Fauci, and Blasio on purpose!! You are down to only 10 percent unvaxed now. this document could have turned the tide earlier, because your members needed that moral support. I'm an exemption tactician. One time, we couldn't figrure out why Sykes at DoE was denying exemptions. She was up to 5 denials before December, when her rate was usually 3 per semester. So I listened to the interview tapes and I realized 2 minutes into the first one what was going on. Each of my clients pushed "2" requesting a translator. I checked my files and saw that each client was foreign. 2 polish, a japanese and 2 hispanics. I called to confirm. Apparently, Sykes has anticipated telling the appellate judge that these parents could not have drafted their statements in perfect syntax, which they were!! From that point on, me and my partner Maja would ask parents to indicate in their intake form their English proficiency, and call them to gauge the degree of it. After a parent would draft their statement from our DIY kit, we would dumb down the grammar and syntax in their drafts to match their verbal language. This is the work I did. It's not lawyer's work. But I read your case and Gibson should have had a slam dunk. I say SHOULD have, not that I expected it. Teachers in NYC are virtually all Democrat. But Bud Weiss begged me to write a defense for them. I owed him that favor, so I did. But later I felt empathy for teachers and other workers who called me in tears about their future entering the dumpster. Bud told me he would get NY Teachers for Choice to email my document to it's members. That was the sole reason I busted a gut to complete it on Sept 13. Bud and Anthony Bloch told me they sent you the document on that day. After a week, no one from your group emailed or called me. I asked Bud how many members there are? Did they post or email it? No email reply. I asked the same question a week later. No reply. Yesterday morning at 2 AM, I called Bud and he refused to give me your phone number. THAT's when I smelled a rat. So there was no need for you to tell me you hadn't even read it. I deduced that already. What I can't understand is why? You need to spend time with your kids? You're lucky. I have to spend time healing and I can't. For 20 years my job trapped me in a chair all day and night. I have compression neuropathy in both feet, and bone on bone arthritis in the knees and pinched sciatic nerve. I can't walk one block, let alone march at Gilmore's rallies in Albany. When Dems repealed religious waivers, I looked forward to getting better. In 2019, I retired and was regaining some of my health. Then last December I was diagnosed with 3rd stage colon cancer. I wanted to enjoy what was left of my life. But people in college and workplace needed help. I'm still looking for competent and honest people to take over my work using my tools. (That leaves out Miller and Palma, of course.) How many more teachers will cave while you take time out to play with your 3 year old? It went from 20 percent to 10 percent in the two weeks you dawdled on something that could have made a difference. This will be the last time I attach these files in question.
