WAIVER OF IMMUNIZATION. -- The statute clearly requires a waiver to be issued upon receipt of written evidence of a medical contraindication to the administration of any vaccine, and the statute does not require that a specific reason be given for a medical contraindication. Jones v. State Dep't of Health, 18 P.3d 1189 (Wyo. 2001)
The statute mandates the issuance of an exemption from immunization for school children upon a written religious objection and does not permit an inquiry by the department of health into the sincerity of the religious beliefs of an applicant. LePage v. State, 18 P.3d 1177 (Wyo. 2001)

Birth Exemptions:

For those who are planning a hospital birth but want to evade invasive routine post natal procedures such as a Hep B shot, vitamin K injection, newborn screening, or the application of silver nitrate in the newborn's eyes, a very specific birthing plan must be submitted to the hospital in advance of the birth. Hospital staff must be informed, in advance, of your needs, wants and desires where your baby and birthing experience are concerned. The same applies to midwives.

Your questions were referred to me for a direct response. I will address each of the questions individually.

1. Vitamin K: There are no statutes that mandate Vitamin K administration for all newborns. Most hospital medical providers have a set list of orders that are routinely followed and vitamin K administration is probably on that list for all providers that provide services in the hospital setting. If a parent does not want to have the dose of vitamin K given to their newborn, they should discuss this with the provider before the delivery since Vitamin K is often given soon after delivery.

2. Silver Nitrate eye drops: [No longer current]There are no statutes that mandate Silver Nitrate eye drops for all newborns. Most hospital medical providers have a set list of orders that are routinely followed and Silver Nitrate eye drops are probably on that list for all providers that provide services in the hospital setting. If a parent does not want to have the Silver Nitrate eye drops given to their newborn, they should discuss this with the provider before the delivery since Silver Nitrate eye drops are often given soon after delivery.

3. There is a statute that addresses both Newborn Metabolic Screening and Newborn Hearing Screening. The statute mandates both screens for all newborns but parents can "opt out" of one or both screens. Parents are asked to sign a separate consent form for both procedures and there is an option on both forms for the parent to forgo the testing. All that is needed is to sign the denial statement on the consent form.

It shall be the duty of every practicing or licensed physician in the state of Wyoming, when attending the birth of a child, to introduce or cause to be introduced into the eyes of the newborn infant a stable solution or ointment of a broad spectrum antibiotic as prescribed by the state department of health. Provided, that this section shall not apply in cases where the parents are religiously opposed to the use of drugs and so inform the attending physician.

I need to know what the Wyoming statutes say on Vitamin K at birth. Can a person refuse it for religious or personal reasons? Can a natural substitute in lieu of Vitamin K, like this natural alternative at

Exemptions from newborn screening allowed.

Wyo. Stat. § 35-4-801 requires informed consent of parents to be obtained in order to screen for detection of metabolic diseases. If any parent or guardian of a child objects to a mandatory examination the child is exempt from the law.

Alternatives to Vitamin K Prophylaxis...

Although oral vitamin K is not licensed for use as a drug by the FDA, drops for oral administration are available. Typically, one drop contains 2 mg. of vitamin K. Contact a midwife in your area, or a birthing supply company (such as birthwithlove.com), or Scientific Botanicals (206 527-5521) where your health care provider can order liquid vitamin K directly.

Here's another much safer alternative that your chiropractor or naturopath can order for you.

A good organic whole food diet along with lots of leafy green vegetables is all that is necessary to prevent vitamin K deficiency in newborns.

Sample Vaccine Letters

Most states now require the Hepatitis B vaccine for newborns. Many parents are also cornered by emergency room personnel during accident visits. Hospitals nationally are under pressure to utilize every opportunity to score a "hit." If your pediatrician understands your views, get him involved with the hospital. As a last resort, protect your right to receive quality care in the following manner. (Usually, you'll never find anybody in the hospital to sign this simple form):

"I certify that the (Name of Vaccine)________ vaccine being administered to (Name of Child)_________ is free from all known and yet unknown zoonotic or human viruses or viral fragments and will not cause acute or chronic illness in the recipient due to viral contamination or as a reaction to the components of this vaccine. (Signature of Physician and Date)_________."

If you do get a signature, hold on to the form.

It is in "duplicate" form, which is one white sheet attached to a yellow sheet that will be separated, probably by the county or state health officer after he signs it. Susan Pearce wrote the following to a woman who recently moved to Wyoming. This letter explains the exact procedure you need to follow in applying for the religious exemption. This applies to children through high school.

March, 2006:
        There won't be any problem getting the exemption. You're fortunate to be coming to this state now rather than in the 1990s, when it was difficult to obtain an exemption. In 2001, two Wyoming Supreme Court cases (medical and religious) were won by two courageous women and now it is simple to get exempted.
        You do not need to write a letter stating your religious objection.
        You need to go the public health nurse's office (community health) and ask for the religious exemption forms, one for each child.   The form they will give you has two pages that are attached.   One is just a carbon copy of the other.   The top paper is white; the underneath paper is yellow.   After you fill it out and have it notarized, return it (both the top page and the carbon copy page) to the public health nurse's office or mail it to Wyoming Department of Health, 117 Hathaway Building, Cheyenne, Wyoming 82002. That address is right on the form, already, for your convenience.
        In the place where the form says, "List the specific immunizations to be exempted" I would put the words All of them.
        It would be best to get the exemptions now.   The reason I wouldn't wait is that the religious exemption could be taken away by the legislature at any time they are in session.
        They probably won't ask you about previous vaccinations your children might have received.   There is no place on the form about that.   Lots of people are getting exemptions after having vaccinated their children previously.   I did.   I'd be really surprised if they asked you.
        When I got mine (in 1999), exemptions were really hard to get.   I had to write a detailed explanation of my religious beliefs.  I even chose to have an attorney write a letter saying it was against my religious beliefs.   I also got my pastor to write a similar letter.   Those three things weren't enough.   I had to explain even more, so I wrote an even longer letter, which finally convinced the state health officer of my sincerity.  It was ridiculous.
        [Note:   I would make a photocopy before mailing it off because it might get lost in the mail.  (But if it did, you would probably need to get a new form and get it notarized.   The photocopy would prove that you have started the process, and it has the date.)   If your child is going to be in a child care facility, when your child stops using the services of that facility, I suggest you try to remember to get the original form back, that you are giving to them.]

The Chickenpox vaccine containing WI-38, MRC-5 and Hepatitis-A vaccine (MRC-5) were obtained from human babies that were electively aborted. TB Testing Alternatives...

TB can be detected by biofeedback machines that are hooked up to a computer, such as the QXCI, Best BioMeridian MSAS (Meridian Stress Assessment) or Electro Dermal Screening, Quantum Life System, and the F-Scan. You will need to ask specifically for a pathogen scan, especially TB. You will also need to request a printout with the results.
