On August 8, 2002, Governor James McGreevey signed the Hepatitis B Vaccine Mandate for High School and College Students into law. This is the first mandatory vaccination law that the New Jersey Legislature ever voted into law and then actually had signed by the Governor. The Hepatitis B vaccine mandate for infants was passed by the Legislature a few years ago but then it was pocket vetoed by then Governor Christine Whitman. All of the other vaccination mandates have been written as Health Department Regulations and sunset (must be re-adopted) every five years. They do not enjoy the same force of law as the ones that are actually passed by the legislature. Many thanks to those who took the time to write. Rome was not built in a day. Persistence is everything!

The Model Emergency Health Powers Act-MEHPA (A-2206) is currently receiving attention from Health Commissioner Clifford Lacy, MD and Assemblywoman Joan Quigley. It appears to be in the Assembly Homeland Security and State Preparedness Committee of which Assemblywoman Quigley is Chairman. If you would like to be called when this bill is heard in committee in Trenton, please call the OLS Aide David J. Lorette at (609) 292-5526 and ask to be notified for the hearing. You can testify or just go to show your support for those testifying against this bill. To see which other states have accepted or rejected MEHPA see www.alec.org. A number of families used the 20 page CHERUBS religious exemption letter for vaccinations successfully this fall. However, a pattern is starting to emerge among new school superintendents. It seems that school nurses sometimes take advantage of the fact that the superintendent is new and instead of filing the exemption letter in the child�s school file, the letters get sent to Trenton to be summarily rejected by the Health Department. This results in scary letters being sent to parents telling them that they have 5 days to get their child vaccinated or he will be kicked out of school.

In one such case this fall, I encouraged the parent to call her state legislators, all three of whom had voted against the Hepatitis B Vaccine Mandate last spring. They contacted Dr. Eze of the NJ Health Department who wrote the letter excluding the child only to find that Dr. Eze did not exist! Wow! So you see if you scratch the surface a little it is not hard to get your child into school.

If the school does exclude your child for any length of time they are required to pay for a tutor for the time your child is out. Additionally, you can ask to have your child bussed to a school district where exemptions to vaccinations are accepted at the expense of your own school system. Calling your state legislators (even if they are not sympathetic to the vaccination issue) is always a good start because it is their job to make government work for you when it seems not to be working.

Senator Vitale has sponsored S-1655 which is a Meningitis Vaccine Mandate for College Students, possibly being amended to include High School Students. The OLS Aide for the Senate Health Committee is Eleanor H. Seel (609) 292-1646. You can call her and ask to be notified when this bill is to be voted on in the Senate Health Committee in Trenton so that you can attend and voice your opposition.

Lastly, for now is Assembly Bill A-1092 which is the Chickenpox Vaccine Mandate for School Children sponsored by Assemblywoman Clare Farragher and Assemblyman Eric Munoz. To request to be notified for the Assembly Health Committee Hearing on this bill please call OLS Aide David Price at (609) 292-1646.

On a lighter note, more and more parents are contacting me who have not vaccinated their babies and want to be able to defend their decision. In addition to Blairstown we have the beginnings of support groups starting in Millburn, NJ and Highland Park, NJ. Also please tell everyone you know that there are religious exemptions to vaccination and that they are eze (no pun intended) to file!
