The federal Vaccine Injury Compensation Program, better known as "vaccine court," has just awarded millions of dollars to two children with autism for "pain and suffering" and lifelong care of their injuries, which together could cost tens of millions of dollars.

The government did not admit that vaccines caused autism, at least in one of the children. Both cases were "unpublished," meaning information is limited, and access to medical records and other exhibits is blocked. Much of the information presented here comes from documents found at the vaccine court website.

The vaccine court can be a hostile place not only for petitioners but for their expert witnesses too.

Take the case of Dr. Derek Smith. A neurologist and assistant professor at Harvard Medical School, Smith had been retained to testify for people with transverse myelitis, a potentially paralyzing neurological disorder.

Smith said he was "highly confident" that the tetanus vaccine could trigger the ailment in certain vulnerable individuals. Officials with the Vaccine Injury Compensation Program strongly disagreed.

Petitioners in vaccine court can have a tough time finding top experts, in part because many doctors are reluctant to say vaccines can cause harm. But Smith had no such qualms.

"He was so smart," said Sylvia Chin-Caplan, a lawyer for dozens of victims of the neurological ailment. "I had somebody who had academic credentials, who did research and had a clinical practice," she said. "Those are the best people you can get."

Then Smith quit.

According to court papers and interviews, Smith decided to bail out after complaints were lodged with his superiors by three other experts with a long history of testifying for the government in vaccine court.

A French Court has fined a doctor 3000 Euros for failing to inform a patient of all side effects of a vaccination. This included the risk of multiple sclerosis from the Hepatitis B vaccine.

This is an important decision which reinforces in law the doctor’s obligation to obtain informed consent from a patient.

The state has granted powers to individuals though the use of titles, uniforms and badges; in this instance both ‘social worker’ and ‘police officer’ are the titles used to seize custody of Jodi Ferris’s newborn child after she questioned the hospitals ‘safety plan’. Once in the custody of the state the baby was injected with a Hepatitis B vaccination and the mother was evicted from the hospital and forced to stay in the parking lot, only permitted to return every three hours to breast feed her newborn daughter.

The next morning the court system determined this was a violation of Constitutional laws and the baby was immediately returned to the custody of her parents with no mention of the possible damage done to her immune system after receiving this toxic concoction.

2013 was only a few days old when I saw a photo of 61-year old Ethel Hoover. . veteran hospital nurse, who had only missed 4 or 5 days of work in 22 years, she was fired from her job for declining to get a flu shot.

Defending Freedom of Conscience

On her last day of work, she wore black. In the photo, she was standing straight, looking directly into the camera, unafraid, signaling strong ownership of the principled choice she made in defense of autonomy, [1] freedom of conscience [2] [3] and protection of bodily integrity. [4]

The Methodist-founded Indiana University Health Goshen Hospital rejected the medical and religious exemptions Ethel filed so they could punish her for obeying her conscience and choosing to stay healthy another way. Eight employees, including at least three veteran nurses, have been fired by Goshen Hospital, in Goshen, Indiana, for refusing the flu vaccine. A religious exemption is available, but was denied because these employees did not meet the criteria for religious protection established by the Equal Employment Opportunity Commission. "What gives the EEOC the authority to define what constitutes an acceptable religious belief?" asks Jane M. Orient, M.D., executive director of the Association of American Physicians and Surgeons (AAPS). MONTPELIER — The Vermont Health Department has softened a rule affecting parents who want to skip vaccinations for their children, after some of those parents complained that asking them to sign a form talking about the risks and benefits of the shots amounted to unconstitutional “compelled speech,” a health official told lawmakers Thursday.

Deputy Health Commissioner Tracy Dolan said an earlier draft required parents seeking an exemption from vaccinations to sign a form acknowledging that they “understand that failure to complete the schedule (of shots) increases the risk to the person and others.”

Parents now will only be required to say they have read the department’s educational materials on vaccines, Dolan told the Legislative Committee on Administrative Rules. They will have to sign a form each year that says: “I have reviewed and understand the Required Parent Education Information developed by the Vermont Department of Health.”

Committee members voted to accept the department’s revised rules after the panel’s chairman, Rep. Richard Marek, a Newfane Democrat and lawyer, said he believed the revisions described by Dolan addressed the constitutional concerns.

The joint committee, made up of House and Senate members, reviews executive agency rules to be sure they comply with the intent of laws passed by the Legislature. If the committee objects to a rule, the executive agency can implement it anyway, but the committee objection would give anyone suing the state over the rule a stronger leg to stand on in court.

SACRAMENTO, Calif. -- Parents who send their children to private schools in California are much more likely to opt out of immunizations than their public school counterparts, an Associated Press analysis has found, and not even the recent re-emergence of whooping cough has halted the downward trajectory of vaccinations among these students.

The state surveys all schools with at least 10 kindergartners to determine how many have all the recommended immunizations. The AP analyzed that data and found the percentage of children in private schools who forego some or all vaccinations is more than two times greater than in public schools.

The vote on the amendment was 93 to 36.

Andrew Wakefield, the doctor who was struck off the medical register after triggering a health scare linking autism to the MMR vaccine, is suing the editor-in-chief of the British Medical Journal for defamation.

In a complaint filed to a district court in Texas, lawyers acting for Wakefield claim that articles, editorials and other statements that appeared in the BMJ were "false and make defamatory allegations" about the doctor.

GlaxoSmithKline Argentina Laboratories company was fined 400,000 pesos by Judge Marcelo Aguinsky following a report issued by the National Administration of Medicine, Food and Technology (ANMAT in Spanish) for the killing of 14 babies during illegal lab vaccine trials conducted between 2007 and 2008.

Likewise, two doctors -Héctor Abate, and Miguel Tregnaghi- were fined with 300,000 pesos each for irregularities during the studies.

The charges included experimenting with human beings, falsifying parental authorizations so babies could participate in vaccine-trials conducted by the laboratory from 2007 to 2008.

Since 2007, 15,000 children under the age of one from Mendoza, San Juan and Santiago del Estero have been included in the research protocol, a statement of what the study is trying to achieve. Babies were recruited from poor families that attended to public hospitals.

A total of 7 babies died in Santiago del Estero; 5 in Mendoza; and 2 in San Juan.

On Thursday, August 18th, 2011, a meeting was held in Washington, DC hosted by John Thompson - Deputy Director, Office of Environmental Policy, U.S. Department of State. It was very eventful.

Pediatric Academic Societies’ Annual Meeting 2011

New data suggest that metabolic bone disease, not child abuse, may be the cause of multiple unexplained fractures in some infants.

“Classic metaphyseal lesions, posterior rib fractures and fractures in different stages of healing are thought to be pathognomonic for child abuse,” researchers wrote. “However, we believe these findings can also be seen in metabolic bone disease of infancy.”

On February 22, 2011, the U.S. Supreme Court ruled in Bruesewitz v. Wyeth that vaccine makers are immune from lawsuits charging that the design of a vaccine is defective. Many physicians and public health organizations applauded this outcome, believing that it will help to ensure the availability and promote the appropriate use of childhood vaccines. Others worry about what it may mean for patients’ rights.

... in 1986, Congress enacted the National Childhood Vaccine Injury Act (NCVIA), establishing a no-fault compensation system (“vaccine court”) for children who were harmed by adverse events following vaccine administration, as long as there was evidence that the vaccine actually caused the problem. The system is expert-driven, and there are no jury trials. Compensation covers the costs of medical expenses, projected lost earnings, and up to $250,000 for pain and suffering but does not include punitive damages. It is paid out of taxes levied on each dose of vaccine. Although the NCVIA permits plaintiffs to reject an outcome and file a claim in court, its key preemption provision says that “no vaccine manufacturer shall be liable in a civil action for damages arising from a vaccine-related injury or death . . . if the injury or death resulted from side effects that were unavoidable even though the vaccine was properly prepared and was accompanied by proper directions and warnings.”

- the cost to the UK has been estimated to be £28 billion per annum.

Poul Thorsen, indicted last week (HERE) by US Attorneys for embezzling tax payers money via the Centers for Disease Control, also received $1 Million in funding through an Autism Speaks grant in 2008 (HERE). Now Autism Speaks is trying to hide their Thorsen affiliation. Why is that?

Families across the country work diligently to raise money for Autism Speaks at over 80 walks per year, despite the knowledge that Autism Speaks' research approach has always been to supplement projects currently underway by the CDC and NIH. This arrangement between Autism Speaks and the CDC/NIH amounts to a supplemental federal tax. However, walkers are willing to contribute, and individuals can light their money on fire by contributing at walks if they want.

Poul Thorsen crafted the plan to use Denmark vaccination data despite the fact that CDC, Thorsen and the NAAR board all knew that Denmark's vaccine schedule then, and now, is not remotely similar to the US vaccine schedule. The results of the Denmark studies helped the CDC out of a tough spot and over the past decade, Thorsen's studies were utilized by the CDC repeatedly to falsely reassure the American public about the safety of vaccines. CDC certainly owed Thorsen.

A Danish man was indicted Wednesday on charges of wire fraud and money laundering for allegedly concocting a scheme to steal more than $1 million in autism research money from the Atlanta-based Centers for Disease Control and Prevention.

The indictment charges Poul Thorsen, 49, with 13 counts of wire fraud and nine counts of money laundering. The wire fraud counts each carry a maximum of 20 years in prison and the money laundering counts each carry a maximum of 10 years in prison, with a fine of up to $250,000 for each count.

Reuters reports that US prosecutors have indicted and seek the extradition of Aarhus University, Denmark’s MMR/mercury & autism researcher Poul Thorsen 49, on 13 counts of wire fraud and nine counts of money laundering. This relates to monies paid to Thorsen by the US Centers for Disease Control including for research into the relationship between autism and exposure to vaccines. Thorsen used the stolen money to buy a home in Atlanta, a Harley Davidson motorcycle and two cars, prosecutors said.

The Pediatric Infectious Diseases Society recently issued a position statement that “opposes any legislation or regulation that would allow children to be exempted from mandatory immunizations based simply on their parents’, or in the case of adolescents, their own, secular personal beliefs.”

In the statement, Christopher J. Harrison, MD, of the Pediatric Infectious Diseases Society (PIDS), and others, including Infectious Diseases in Children Editorial Board member Paul A. Offit, MD, said any legislation being considered should contain certain provisions; notably, that parents who are claiming exemptions be given counseling about the importance of immunization to their own child, as well as the community overall, and that parents would have to sign a statement that they understand the risks of not immunizing their child.

A mother whose son suffered severe brain damage after he was given the controversial MMR vaccine as a baby has been awarded £90,000 compensation.

The judgment is the first of its kind to be revealed since concerns were raised about the safety of the triple jab.

A Southwest Florida father is suing the Lee County School District over its immunization policy.

Acupuncture physician Robert Murdoch has not had his two teenagers vaccinated.

After extensive research, he's decided vaccines are not effective and even down-right toxic because some include mercury, aluminum and formaldehyde.

"People are being coerced into a medical treatment that has very suspect science behind it," he explains.

The school district granted his kids exemptions so they could go to school, but you'd never know you had that right by looking at the district's website.

Robert made a personal appeal to Superintendent Browder in hopes of making the exemptions known to parents, but his request was rejected.

And that's why he is suing, he wants you to know there are exemptions to the immunization requirement.

(NaturalNews) Controversy over the safety of the human papillomavirus (HPV) vaccine has led to a resolution to end mandates requiring young girls to receive it. If passed by the Virginia state Senate, a bill recently passed by the Virginia House of Delegates will end mandates put into place in 2007 requiring 11- and 12-year-old girls to receive the HPV vaccine before entering sixth grade.

"We just want to make sure parents are evaluating the risks of what they're giving their daughters, and not a legislative body," said Del. Kathy J. Byron (R-Lynchburg), sponsor of the bill. "I don't think that we have the medical degree to make those decisions."

The House voted 61-33 to end the mandate, leaving only Washington D.C. with HPV vaccine mandates. Texas Gov. Rick Perry attempted to mandate the HPV vaccine for young girls in 2007 through an executive order, but lawmakers effectively blocked it.

Administrators turned away hundreds of students in an Oregon county who did not comply with a previous ruling of mandatory vaccinations earlier this week.

School officials thought it would be appropriate to give children a green sticker of approval if they (and their parents) succumbed to the pressure imposed on them to receive the highly controversial flu vaccinations. Those without the sticker were told to go home.

Results. Undervaccinated children tended to be black, to have a younger mother who was not married and did not have a college degree, to live in a household near the poverty level, and to live in a central city. Unvaccinated children tended to be white, to have a mother who was married and had a college degree, to live in a household with an annual income exceeding $75 000, and to have parents who expressed concerns regarding the safety of vaccines and indicated that medical doctors have little influence over vaccination decisions for their children. Unvaccinated children were more likely to be male than female. Annually, ∼17 000 children were unvaccinated. The largest numbers of unvaccinated children lived in counties in California, Illinois, New York, Washington, Pennsylvania, Texas, Oklahoma, Colorado, Utah, and Michigan. States that allowed philosophical exemptions to laws mandating vaccinations for children as they entered school had significantly higher estimated rates of unvaccinated children.

What are the characteristics of children who have received no vaccinations compared with those who are undervaccinated and to those who are fully immunized?

The findings
In 2001, 62.8% of US children 19 to 35 months of age were fully immunized with all the vaccines that were recommended at that time. It was estimated that 3 children per thousand had never received any vaccines (unvaccinated). The study found marked differences in the characteristics between children who were completely unvaccinated, those that either received some vaccines, and those who were fully vaccinated as recommended.

Children who had received some but not all recommended doses (undervaccinated) tended to be black and had a younger, often-unmarried mother who had less education than fully immunized children. These underimmunized children were more likely to live in a household below the poverty level, with more children, and had moved across state lines.

Compared to undervaccinated children, unvaccinated children were more likely to be non-Hispanic white, have a mother who was older, married and who had a college degree. These children were more likely to live in a household with an annual income exceeding $75,000.
